Auto Insurance: It is not all the same.

It is not uncommon for an individual to choose the least expensive auto insurance policy available.  This may not be an area where cutting cost is in your best interest.  It’s important to know exactly what your policy does, and does not, include, as well as, what the different types of coverage actually do and do not protect.

Liability Coverage

In California, all vehicles in operation must have “financial responsibility” i.e. insurance. Liability insurance is the most basic policy to meet the insurance requirement.  Liability only compensates the other people involved in the accident (when the accident is your fault), and not the policy holder.  If your policy is only liability coverage, your car and your injuries will not be covered under this policy.

Liability Coverage Minimum Limits

In California, the minimum liability insurance requirements are 15/30 ($15,000 per person, $30,000 per accident) and $5,000 for damage to property. While minimum coverage policies will be cheaper, they still open the driver/owner up to personal liability. If you are at fault in an accident where injuries and damage exceed the limits of your policy, you can be personally sued for the difference.

Collision Coverage

Collision coverage is recommended because the policy will cover the damage to your vehicle.  Even when the vehicle itself is worth very little, the cost to repair or replace the vehicle may be much greater than the additional monthly payment to include this coverage on your policy.

Med Pay

Med Pay coverage covers medical bills for the driver of the vehicle.  This includes medical bills when the driver is at fault for the collision.  Medical bills can be costly and some services may not be covered under general medical insurance policies and programs, so each individual should plan for how they would pay for treatment after an accident.

Uninsured/Under-insured Motorist Coverage

We highly recommend our clients obtain Uninsured/Under-insured Motorist coverage in their auto insurance policy. This coverage works when you are not the at fault party in the collision but the party at fault either does not have insurance, or has policy limits too low to cover all your injuries and damages.

Excluded Drivers

Be careful not to allow excluded drivers behind the wheel, even in an emergency, as your policy will not cover your liability. If someone lives in your household and will be driving the vehicle, you should include them on your policy.

Do I Need Lawyer?

The most common question asked by friends, family, and past clients is, “Do I need a lawyer?” Generally speaking, yes. It is always best to at least consult a lawyer where a legal, or potentially legal, issue is involved. Most law firms offer a short consultation at no charge. Call The Law Offices of Manny Ibay at (310) 838-6788 to discuss your issues and determine if representation is in your best interest.

Domestic Violence Restraining Orders

If you or your family is in imminent danger, contact the local police department.

A restraining order is a legal order that may be used to protect you and your family from domestic violence. Domestic Violence includes harassing phone calls, physical attacks, striking, stalking, threatening, sexual assault, and destruction of property. Whether these behaviors take place in a marital or dating relationship they may deterred or stopped by a restraining order. Call The Law Offices of Manny Ibay for a consultation at (310) 838-6788.

Uncontested Dissolution

When both parties in a divorce are able to agree on all matters, such as, the division of real and personal property, child custody and visitation, child support, and spousal support, the parties may present their agreement to the court as an uncontested matter.  By proceeding in this matter is likely to save the parties money and expedite the dissolution process.  For more information on Uncontested Divorce and settlement agreements contact The Law Office Of Manny Ibay at (310) 838-6788 for a consultation.

Don’t Tase Me Bro Guy is Going to Law School

The Washington Post caught up with Andrew Meyer in an unexpected blast from the past. Back in 2007, Meyer was in attendance at a Q&A session after a speech by Senator Kerry. After asking a series of allegedly hostile questions, his microphone was cut off and he was being escorted out of the building when things got interesting. He was wrestled to the ground and tased, screaming “Don’t tase me, bro!” which, thanks to YouTube.com, is now his claim to fame. He was charged with disturbing the peace and resisting arrest but the charges were dropped later that same year. Apparently, his traumatic experience gave him the resolve to pursue a law degree at the University of Florida.

“I got a taste of the system,” says Meyer. The incident made him “want to know how to defend myself. Want to be able to help people.”

We can only hope his tuition costs will be offset by sales of “Don’t Taze Me Bro” merchandise from his website theandrewmeyer.com.
